TERMS OF SERVICE AGREEMENT
Effective Date: 3/4/2025 - Present
This Terms of Service Agreement ("Agreement") is a legally binding contract between Lucky Duck Cleaning Company ("Company," "we," "our," or "us") and the Client ("you," "your") regarding the provision of cleaning services. By booking a service, you agree to the following terms. This Agreement is governed by the laws of the State of California.
1. SERVICES OFFERED
Lucky Duck Cleaning Company provides residential and commercial cleaning services, including but not limited to:

Standard Cleaning

Maintenance Cleaning
-
Recurring Cleanings
-
Deep Cleaning ("Quack Attack")

Move-In/Move-Out Cleaning
-
Special Event Cleaning
-
Membership-Based Cleanings ("Feather Fresh")
The scope of services is outlined at the time of booking and detailed on our website.
2. SERVICE AGREEMENT & CONTRACT TERMS
2.1 Booking & Scheduling

Appointments must be scheduled in advance via phone, email, or our online system.

We reserve the right to reschedule due to unforeseen circumstances (e.g., staff illness, severe weather).
-
Accurate details about property size and cleaning needs must be provided when booking.
-
Clients must provide a safe and accessible working environment for our cleaners.
2.2 Feather Fresh Membership Contract
-
Requires a minimum 3-month contract with at least one cleaning per month.
-
Early cancellation incurs a charge equal to the difference between the discounted rate and standard rate for past cleanings.
-
Auto-renews unless canceled in writing at least 14 days before renewal.
-
Per California’s Automatic Renewal Law (Bus. & Prof. Code §§17600-17604), clients must actively consent to renewal and will receive a confirmation email with cancellation instructions.
3. PRICING, PAYMENT & CANCELLATIONS
3.1 Pricing & Payment

Prices are listed on our website and are subject to change.

Payment is due in full at the time of service, unless otherwise agreed upon.

Accepted payment methods: Credit/Debit cards, bank transfers, online payments.

A $35 fee applies to returned payments due to insufficient funds.

Any late payment exceeding 30 days will incur a 1.5% monthly interest fee, not exceeding the legal usury limit in California.
3.2 Deposits & Late Payments

Certain services (e.g., move-in/move-out cleaning) may require a deposit at booking.
-
Invoices must be paid within 48 hours of service completion. Late payments incur a 5% late fee per week.
3.3 Cancellations & Rescheduling
-
72 hours' notice required for cancellations or rescheduling.
-
Same-day cancellations or no-shows incur a $50 fee.
-
If our team cannot access the property, $50 may be charged.

Under California’s Home Solicitation Sales Act, if services are booked in a client’s home, they have 3 business days to cancel without penalty. If applicable, clients will be provided with a written cancellation form.
4. CLIENT RESPONSIBILITIES
4.1 Access to Property

Clients must provide access via key, door code, or be present at the scheduled time.

If we cannot access the property, cancellation fees apply.
4.2 Home Conditions & Safety
-
The home must be in reasonable condition for cleaning. We do not handle biohazards, excessive clutter, mold, or pest infestations.

Clients must disclose any hazardous conditions before service.
-
Clients are responsible for securing fragile or irreplaceable items before cleaning begins.
4.3 Pets & Valuables
-
Pets must be secured for safety.

Clients are responsible for securing valuables. Lucky Duck Cleaning Company is not liable for lost or misplaced items unless due to gross negligence or misconduct by our staff.
5. LIABILITY & WARRANTY
5.1 Satisfaction Guarantee

If dissatisfied, notify us within 24 hours, and we will re-clean the affected area.
-
Requests made after 24 hours may not qualify for a redo.
5.2 Damages & Liability
-
Our staff is trained and insured.
-
Any damages must be reported within 24 hours.
-
We are not responsible for pre-existing damages, unstable fixtures, or improperly installed items.
-
Liability is capped at the total amount paid for the service, except in cases of gross negligence or intentional misconduct.

We maintain workers’ compensation and general liability insurance for all employees, ensuring compliance with California Labor Code §3700.
6. DISPUTE RESOLUTION & GOVERNING LAW
-
We encourage mediation or informal resolution before pursuing legal action.

Any disputes shall be settled through binding arbitration in California per the Federal Arbitration Act, except for small claims cases.

Clients retain the right to seek public injunctive relief per the McGill Rule.

California law governs this Agreement, and disputes will be resolved in California courts.
7. PRIVACY & CONFIDENTIALITY

We respect client privacy and do not share personal information.

Our staff maintains confidentiality regarding your home and belongings.
8. FORCE MAJEURE
Lucky Duck Cleaning Company is not liable for delays or service failures due to:

Natural disasters (earthquakes, floods, fires).
-
Government restrictions.
-
Labor strikes or supply chain disruptions.
9. AMENDMENTS & CHANGES
Lucky Duck Cleaning Company reserves the right to update these Terms of Service at any time. Continued use of our services constitutes acceptance of revised terms.
10. COMPLIANCE WITH CALIFORNIA LAW

Lucky Duck Cleaning Company is a registered janitorial services provider in compliance with the California Property Service Workers Protection Act (Labor Code §§1420-1434).

Clients contracting with us for commercial cleaning are assured full compliance with California employment and safety laws.
-
We comply with California’s Automatic Renewal Law for subscription-based cleaning plans, ensuring clear disclosures and easy cancellation.
